Welcome to Nightscout Cloud, a managed hosting service for the open-source Nightscout CGM remote monitoring project. By accessing or using our service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the service.

1. Acceptance of Agreement

These Terms and Conditions ("Agreement") govern your use of Nightscout Cloud ("Service"), operated by skHosting.eu s.r.o., Zavadska 10075/16A, 831 06 Bratislava, Slovakia (VAT ID: SK2023710447). By using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Use of the Service

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with this Agreement. You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access, interfering with the Service's operation, or using it for any unlawful purpose.

3. Intellectual Property

The Nightscout software is open-source and licensed under the GNU General Public License (GPL). The Nightscout Cloud platform, branding, and associated materials are the property of skHosting.eu s.r.o. and are protected by applicable intellectual property laws.

4. Modifications and Derivative Works

As the underlying Nightscout software is licensed under the GPL, you are free to modify and distribute derivative works in accordance with the GPL license terms. Any modifications must be made available under the same GPL license.

5. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. While we strive to maintain high availability, we make no warranty regarding the reliability, accuracy, or completeness of the Service. The Service is not a medical device and must not be used as the sole basis for medical decisions.

The Service has not been reviewed or approved by the FDA or any other regulatory authority. Nothing on this website or in the Service is medical advice. If using the Service could affect how you manage your diabetes, talk to your diabetes care team before making any changes.

6. Limitation of Liability

To the fullest extent permitted by applicable law, skHosting.eu s.r.o. shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from the use of the Service shall not exceed the amount you paid for the Service in the three months preceding the claim.

7. Privacy Policy

We collect and process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing. Please review our Privacy Policy for details on how we handle your data.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

9. Governing Law

This Agreement is governed by the laws of the Slovak Republic. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic.

10. Payments

Payments are processed securely through Stripe. By completing a payment, you agree to Stripe's terms of service. Refunds are subject to a 10% processing fee. Any unused credit remaining after a refund will be returned to your original payment method.
